Protecting the security and
Privacy of your personal data is important to the Data Controller, who operates in accordance with current laws on the protection and security of personal data.
We trust that the information provided below will help you understand what kind of data the Data Controller usually collects, how they are used and safeguarded, and with whom they are shared.
Pursuant to Art. 13 of EU Reg. 2016/679 ("Privacy Regulation"), we wish to inform you that the processing of your data will be based on the principles of correctness, necessity, proportionality, adequacy, lawfulness, and transparency, protecting your confidentiality and your rights, in compliance with current legislation on the security and protection of personal data and, in particular, the aforementioned
Privacy Regulation and Legislative Decree 196/2003 (the so-called "
Privacy Code"), as amended by Legislative Decree 101/2018.
In particular, we inform you of the following:
a. Source of personal data
The personal data in our possession are those provided by you at the time of registration in the Reserved Area, by filling out the specific forms on the website https://www.ingegneriasismicaitaliana.com/home/it (from now "Website") such as name, surname, telephone number, email, and website, and/or the email address provided at the time of your request to subscribe to our
newsletter service on the same Website.
All personal data will be processed in compliance with the
pPrivacy Code, the
Privacy Regulation, and the confidentiality obligations that have always inspired the Controller's activities.
b. Legal basis and Purposes of the processing
The purposes for which your data will be processed by us are as follows:
b.1) Management of your requests
By processing the data provided by you, we will be able to provide access to the Reserved Area and dedicated services, to any
newsletter service, to respond to your requests for information regarding the characteristics and nature of services in which you have expressed interest, or related services, in the event that those of your interest are temporarily or permanently unavailable, or regarding any initiatives carried out by the Controller.
In this case, the legal basis for such processing is the execution of pre-contractual measures adopted at your request.
b.2) Establishment, exercise, or defense of legal claims, including by a third party.
For this purpose, the legal basis is the legitimate interest of the Data Controller.
b.3) Fulfillment of specific obligations arising from the existing relationship or to manage everything deriving from the agreement between the parties.
The legal basis for this purpose is the fulfillment of legal obligations.
b.4) Marketing and promotional communications
Subject to your prior consent, by processing the data provided by you, we may also send you information regarding our activities, including our services, promotional material, offers related to our services, as well as invitations to industry trade fairs or events we would like you to attend, via email and/or post and/or telephone. Even if consent is given, you may revoke it at any time by making a request to the Controller in the manner indicated in
point h. below. Once consent has been revoked, you will receive confirmation of receipt of such revocation notice from the Controller.
However, we inform you that, even following the exercise of this right of revocation, it is possible that, for technical and operational reasons (e.g., contact lists already completed shortly before the Controller's receipt of the revocation), you may continue to receive some additional promotional communications. Should you continue to receive promotional communications after exercising the aforementioned right, please report the problem to the Controller using the contacts indicated in
point h. below. The legal basis for the aforementioned processing is the consent to the processing of your data, expressed by you by ticking the checkbox on the Website.
b.5) newsletter delivery
Subject to your prior consent, by processing the data provided by you, we may send you a periodic
newsletter containing information about our activities, including our services.
Even if consent is given, you may revoke it at any time by making a request to the Controller in the manner indicated in
point h. below.
Furthermore, you can easily object to further mailings by exercising the so-called right of opt-out, through the methods present in every type of communication used to send the
newsletters in question. Once consent has been revoked, you will receive confirmation of receipt of such revocation notice from the Controller. However, we inform you that, even following the exercise of this right of revocation, it is possible that, for technical and operational reasons, you may continue to receive some additional
newsletters. Should you continue to receive
newsletters after exercising the aforementioned right, please report the problem to the Controller using the contacts indicated in
point h. below. The legal basis for the aforementioned processing is the consent to the processing of your data, expressed by you by ticking the checkbox on the Website.
c. Processing methods
Data processing will be carried out using manual or electronic methods, suitable to guarantee, in relation to the purposes for which they were communicated and collected, security, as well as to prevent unauthorized access by third parties and, in any case, in compliance with the provisions of national and European legislation.
d. Nature of data provision
The provision of data in relation to the purposes referred to in
points b.1),
b.2), and
b.3) is mandatory as it is a necessary requirement to be able to respond to your requests; in case of failure to provide data, the consequences of your eventual refusal will be the inability to receive information relating to our services for which you have expressed interest and/or the inability to conclude an agreement with you.
The provision of data in relation to the purpose referred to in
point b.4) is optional, but it is a necessary requirement to receive information about our activities, including our services, promotional material, offers, as well as invitations to trade fairs or events; in case of lack of consent, the ability to browse the Website and to spontaneously address requests for information to the Controller will not be prejudiced in any way, except that it will not be possible to receive promotional communications from our Association.
The provision of data in relation to the purpose referred to in
point b.5) is optional, but it is a necessary requirement to receive
newsletters from the Controller; in case of lack of consent, the ability to browse the Website and to spontaneously address requests for information to the Controller will not be prejudiced in any way, except that it will not be possible to receive said
newsletters.
We invite you not to provide sensitive/special categories of data, i.e., data from which, among other things, racial or ethnic origin, religious beliefs, political opinions, membership in parties, trade unions, associations, and organizations of a religious, philosophical, political, or trade union nature, as well as health status, can be inferred. Any sensitive/special data provided will be immediately deleted.
e. Subjects of processing and Data Communication
Your personal data may be disclosed to the Controller's collaborators authorized to carry out activities necessary to achieve the processing purposes referred to in paragraphs
b.1), b.2), b.3) and, where you have consented, for the purposes referred to in
points b.4) and
b.5).
Furthermore, they may be disclosed to IT and logistics service providers functional to the operation of the Website, outsourcing service providers, professionals and consultants, and companies in charge of sending promotional emails, SMS, or promotional communications (where you have consented). These subjects, formally appointed by the Controller as Authorized Persons, Data Processors, and/or System Administrators, will process your data in compliance with and exclusively for the purposes indicated in this policy and under the control and supervision of the same.
Your data may also be communicated to third-party providers who will process them as Data Processors appointed by the Controller or, as the case may be, as independent Data Controllers. The complete and updated list of the subjects to whom your data have been communicated may be requested from the Controller by writing to the email address indicated in
point h. below.
f. Data Disclosure
The Data Controller will not engage in any activity involving the disclosure (dissemination to unspecified subjects) of your personal data.
g. Transfer of data abroad
Your personal data may be transferred to countries outside the EEA (European Union, Iceland, Liechtenstein, and Norway). In such cases, the transfer will take place, for the purposes indicated above, to countries considered adequate by the European Commission, or by adopting suitable measures to protect your personal data, in compliance with legal guarantees, pursuant to applicable regulations and, in particular, Articles 44, 45, and 46 of the GDPR. For further details on the non-EEA countries where your personal data may be transferred and the appropriate safeguards applied, as well as to obtain a copy of such safeguards and a list of the Processors who will process your personal data abroad on behalf of the Controller, you may contact the Controller at any time using the address indicated in
paragraph h..
h. Rights of the Data Subject
Finally, we inform you of the possibility to exercise at any time the rights recognized by law, as listed below:
- access the data provided;
- obtain the rectification of such data, their erasure, transformation into anonymous form, blocking of data processed in violation of the law, or restriction of the relative processing;
- object to the processing of such data;
- obtain the portability of the data in question;
- obtain confirmation as to whether or not personal data concerning you exist, be informed of their content and origin, verify their accuracy, or request their integration or updating;
- be informed of the purposes and methods of processing, the logic applied in case of processing carried out with the aid of electronic instruments, our identification details as Data Controller, and those of our Data Processors, System Administrators, and the DPO (Data Protection Officer), where appointed;
lodge a complaint with the competent supervisory authority (in Italy, the Garante Privacy );
as well as
- obtain, without undue delay, notification of a personal data breach.

i. Data retention period
The data provided by you for the purposes referred to in
points b.1),
b.2), and
b.3) will be kept for the time necessary to process your request for information.
Subsequently, the data provided by you may be stored for a period of ten years in order to comply with legal obligations.
Any further storage of your data may occur in order to establish, exercise, or defend our rights, including in court, until the expiration of the statutes of limitations for such rights, in accordance with current legislation.
Upon termination of the existing relationship, we will continue to store your data if required by EU or national laws, regulations, or ordinances, and for the period stipulated therein.
Furthermore, if, for any reason, the storage of your personal data is no longer justified based on assessments made by the Controller—taking into account the principles of necessity, proportionality, adequacy, and relevance of processing—we will proceed without delay to delete or anonymize them. Only if you have also provided your consent for the purposes
b.4) and
b.5) above, your data will be kept for a period of 24 months.
